Notice to all Owners/Operators of Passenger Ships, Cargo Ships engaged on Domestic Voyages in Ireland, Masters, Local Authorities and Harbour Masters
Maritime Security Measures for Vessels operating on Domestic Voyages in Ireland – Commencing November 2013

Background
EU Regulation (EC) No 725/2004 – Enhancing Ship and Port Facility Security – entered into force on 31 st March 2004.

The objective of this Regulation is to introduce and implement measures aimed at enhancing the security of ships used in international and domestic trade, and associated port facilities within the Member States, in the face of threats of intentional unlawful acts.

Article 3.3 of the Regulation requires that Member States shall, after a mandatory security risk assessment, decide the extent to which they will apply the provisions of this Regulation to different categories of ships operating on national domestic services, their companies and the port facilities serving them.

Member States must notify the Commission of such decisions when they are adopted, as well as of the periodic review, which must take place at intervals of no more than five years.

The Marine Survey Office (MSO) of the Irish Maritime Administration has completed a five year review of security risk assessments for vessels and ports engaged in domestic shipping operation on the Irish coast.

The risk assessment undertaken, took into account a number of considerations:-

• Vessel type
• Size of vessel
• Cargo
• Operating area
• Port facility location base
• Port facility infrastructure
• Interaction with international shipping traffic
• Seasonality of vessel operations
• Passenger numbers
• Nationality of passengers
• Possible threat scenarios posed to, and by, such vessels.

The maritime security measures to be applied as a result of the risk assessment relate to vessels and are defined in the following text.

Maritime Security Measures Applicable to Irish Registered Vessels engaged on Domestic Voyages to sea in Irish waters from November 2013
Vessel security measures must be applied by their owners/operators on the following basis.

Vessel Type 1:
• Passenger vessels carrying in excess of 100 passengers
• Cargo Vessels of 500 GT or more
Such vessels proceeding to sea on domestic voyages must implement the following security measures for their vessel, including:
Appointing a Company Security Officer,
Appointing a Ship Security Officer,
Creating a vessel specific security plan, and
Ensuring all relevant staff undertake suitable security training.

Vessel Type 2:
• Passenger vessels carrying 100 passengers or less
• Cargo vessels less than 500 GT
The above vessels are not required to create formal security plans but must implement guidelines contained in the Annex of this Marine Notice.

Maritime Security Measures Applicable to all Vessels, which do not proceed to Sea, (Smooth and Partially Smooth Waters) from November 2013

Vessel Type 3:
• Passenger & Cargo vessels not proceeding to sea on Domestic voyages
Such vessels are strongly recommended to implement the security guidelines contained in the Annex of this Marine Notice on a voluntary basis.

Maritime Security Measures Applicable to Non-Irish Registered Vessels engaged exclusively on Domestic Voyages to sea within Irish Waters from November 2013
In the case of non-Irish registered vessels operating exclusively on domestic voyages to sea, the following will apply:

Such vessels engaged on exclusive domestic service – no more favourable treatment clause applies prior to entering into service. De minimus rule also applies.

EU Flag >100pax or >/=500GT, must comply with Irish Domestic security requirements for Vessel Type 1, in addition to any imposed by their own Flag administration.

EU Flag =/<100pax or <500GT, comply with their own flag requirements and also with Irish guidance as per Vessel Type 2.

All non-EU Flag vessels, regardless of size or number of passengers, must comply with their own flag requirements and specified domestic security requirements as for Irish flag Type 1 & 2 vessels, as appropriate. An additional risk analysis will be carried out by the MSO in respect of such vessels and any resulting requirements are to be complied with prior to entering into service.

The Guidelines for security of domestic shipping proceeding to sea are contained in the Annex to this Marine Notice and are intended to assist managers of domestically operating ships to enhance security on their vessels.

The guidelines may form the basis for companies required to create a mandatory security plan for their vessels.

The MSO can provide a Security Plan Template to assist those owners required to implement mandatory security measures (Vessel Type 1).

Marine Notice No. 16 of 2007 is hereby revoked.

ANNEX to Marine Notice No. 61 of 2013

Security Guidelines for Vessels engaged on Domestic Voyages to Sea

1.0 Access Restrictions on board ALL vessels.
1.1 Non Public areas of vessels should be controlled to prevent unauthorised access. Such areas would include:
Wheelhouse
Machinery spaces
Cargo Storage Areas
Storage Areas
Crew Accommodation
Mooring stations
Emergency Control points.
Safety Equipment storage lockers e.g. Lifejackets, First Aid, Fire Extinguishers.

1.2 Means of control can include:
Padlocks
Shipboard ID System for Crew / Employees
Keypad access control
Local alarming of doors
Security tagging of items with anti-tamper seals
CCTV Installation
Provision of signage identifying an area as restricted to passengers
Crew undertaking regular patrols to check

2.0 Access Control
2.1 Embarking and disembarking of passengers should only occur via a suitable gangway.
2.2 Embarking and disembarking passengers should always be kept separate.
2.3 Embarking must only be allowed when the crew are present on board to receive the passengers and the vessel has been inspected for any unattended or unusual items.
2.4 Embarkation must not occur while cleaning or maintenance of a vessel is being undertaken.
2.5 Passengers must present valid tickets to crew, prior to being allowed on board.
2.6 Particular attention must be paid by the crew when the tidal conditions present the vessel level with a pier to avoid the instance of an unauthorised boarding of the vessel other than by the gangway.
2.7 In the cases of charter groups, the charter representative travelling should:
Advise the vessel of group number travelling
Muster at an agreed location away from the vessel and account for their group prior to boarding
Confirm numbers of mustered group to the vessel.
The boarding of such groups should be overseen and numbers confirmed by a crewmember that liaises with the organiser. A counting device such as a clicker should be used to account for number of persons boarding.

3.0 Pre-departure security announcements
3.1 Pre-departure announcements should advise passengers:
Not to leave any baggage unattended
Report any suspicious items noted on board
Not to enter any restricted areas on board
Consideration should be given to having such advice issued as security posters on board.

4.0 Luggage carried on board
4.1 Unaccompanied luggage should not be placed on board unless satisfactory means of verifying its contents are provided.
4.2 Unless there is a central luggage store, passengers should be, for security purposes, instructed to remain with their luggage at all times.
4.3 On completion of any trip and prior to the next departure, the vessel should be swept for any remaining unaccounted luggage items.

5.0 Visitors and repair contractors
5.1 Official visitors and contractors should present themselves initially to the shore office for clearance prior to attempting to board any company vessel.
Contractors should be asked to provide proof of identification. Passport, Drivers licence or verified company ID are acceptable means of proof.
5.2 A dedicated visitor's pass should be provided by vessel operators, with associated records of who has accessed their vessels.
5.3 Visitors and contractors should be given a security / safety briefing prior to boarding the vessel.

6.0 Security Patrols
6.1 Security patrols are most effective as a deterrent when carried out by uniformed staff and crew members, and improve the chances of recognising unattended or concealed items.
6.2 Items of uniform may include company branded Hi Visibility vests, tee shirts, coats, boiler suits etc.
6.3 Such duties should be shared between suitable trained crew and should be incorporated into their regular duties and routines.
6.4 An agreed search procedure should be in place by the operator to include a check of:
All passenger areas including toilets and luggage storage areas
Cargo holds and common work areas of cargo vessels
Integrity of all restricted areas on board after each voyage.

7.0 Securing Vessels
7.1 Where practical, external doors and storage areas should be kept locked shut, while allowing means to exit rapidly from within the vessel in the event of an emergency.
7.2 If the vessel is left unattended for a period of time such as overnight or seasonal lay-up, the engines should be disabled to prevent theft or unauthorised use.
7.3 Out of service vessels should be securely moored.
7.4 Gangways should be lifted and not left in position on an unattended vessel.
7.5 In ports with mobile security patrols, security staff should be aware of the status of vessels berthed in their port, e.g. laid up, visitor, overnight stay etc.
7.6 Owners should consider the installation of a basic alarm system to detect and warn against tampering with out of service vessels.

8.0 Standard Operating Procedures (SOPs)
8.1 SOPs recommended to be established:
Response to bomb threats
Visiting contractors
Cleaning routines
Vessel inspection routine
Securing of vessel when out of service and security sweep prior to re-entering the vessel.

9.0 Emergency contacts list
9.1 All operators should compile a list of emergency contacts, which should be kept on board the vessel for use in the event of any potential security or even a suspicious incident. The contacts list should include but not be limited to:
Local Garda Station
Local Garda Crime Prevention Officer (for advice on security)
Regional Marine Survey Office (Department of Transport, Tourism & Sport)
Local Harbour Masters (if applicable)
Irish Coast Guard – National Maritime Operations Centre (NMOC) (to report any security incident at sea).

10.0 Interagency Co-Operation
Operators are encouraged to discuss their security issues with other services and transport facilities, e.g. Bus Services, Cargo Haulage companies; advise them of their security ship board policies, and agree how these services can assist operators in implementing them.

Furthermore, operators are advised to meet with Local Authorities, Port Officials, Gardaí and the Department of Transport, Tourism & Sport to discuss their needs.

 

The authorisation will cover work as an RSO in relation to both Regulation 725/04/EC and Directive 2005/65/EC on Port Security. (The current arrangements of two separate panels of RSOs will cease on 31/12/13).

Section 1 Overview of Applications Sought

Introduction:

Recognised Security Organisations (Ports) will be authorised to carry out security assessments in ports and facilities, produce security plans and provide training and advice to ports in accordance with EC Regulation 725/2004 and S.I.No. 284/2007 – European Communities (Port Security) Regulations 2007 which implements EU Directive 2005/65/EC into Irish Law.

Applications are invited from individuals, organisations or companies (including port authorities) who wish to be authorised as an RSO(Ports).

Section 2 Statement of Requirements

2.1 General Requirements

The Department of Transport, Tourism and Sport wishes to authorise Recognised Security Organisations – RSO (Ports) to carry out security assessments in ports, produce security plans and provide training and advice to ports in accordance with EC Regulation 725/2004 and S.I.No. 284/2007 – European Communities (Port Security) Regulations 2007 which implements EU Directive 2005/65 into Irish Law. The Department will consider applications from individuals or from Companies as follows.

All applicants must be able to demonstrate the following:

Have a good working knowledge of the ISPS Code and EU legislation with detailed knowledge of the regulatory requirements for ports and port facilities.

Be able to demonstrate competence in the following areas in accordance with paragraph 4.5 of Part B of the ISPS Code and Annex IV of Directive 65/05/EC

expertise in relevant aspects of port security;

appropriate knowledge of port operations, including of port design and construction

capability to assess the likely security risks that could occur during port and port facility operations, including the ship/port interface and in the wider port area, and how to minimise such risks;

an appropriate knowledge of other security relevant operations potentially affecting port security;

ability to maintain and improve the expertise of their personnel;

ability to monitor the continuing trustworthiness of their personnel;

ability to maintain appropriate measures to avoid unauthorised disclosure of, or access to, security sensitive material;

knowledge of the requirements of SOLAS chapter XI-2 and part A of the ISPS Code and relevant Irish and international legislation and security requirements;

knowledge of current security threats and patterns;

knowledge of recognition and detection of weapons, dangerous substances and devices;

knowledge of recognition, on a non-discriminatory basis, of characteristics and behavioural patterns of persons who are likely to threaten security;

knowledge of techniques used to circumvent security measures;

knowledge of security and surveillance equipment and systems and their operational limitations.

Individual Applicants must be able to demonstrate the following:

That a Quality Management System will be established to cover the Recognised Security Organisation (RSO) (Ports) before commencement of services and which, if not certified to ISO9001 standard, is to be to the satisfaction of the Marine Survey Office.

Have appropriate relevant qualifications acceptable to the Department. Qualifications will be considered on a case by case basis at the sole discretion of the Department. The Department may also consider restricting the RSO (Ports) activities of individuals, as appropriate to their capacity.

All candidates are to demonstrate continuing professional development such as membership of a relevant recognised professional organisation.

Organisations must be able to demonstrate the following:

That they have and will maintain a complement of suitably qualified staff (in line with the above individual requirements) to carry out the RSO(Ports) function and that there is in place a third party certified quality management system in accordance with the ISO9001 or equivalent standard covering as a minimum the operational parts of its RSO (Ports) functions. A copy of the current certificate is to be submitted with the application.

Section 3 Conditions of Application

Applications are subject to the following:

3.1 Applications to be submitted electronically to email:[email protected]

3.2 The application procedure will be open until 15.00 on the 29th November, 2013 and may be opened again by the Department. Interviews and appointment of Surveyors and organisations may take place prior to this date. However, it is anticipated that the interviews will commence in late November.

Information supplied by applicants will be treated as contractually binding and subject to the conditions and requirements laid down in this document. The Department reserves the right to seek clarification or verification of any information contained in the applications.

Applications must be completed in accordance with the format specified in Section 5. Applications, which do not comply with this requirement or are incomplete, may be rejected.

3.5 It will be a condition of appointment that the successful applicant will give a binding undertaking that they will not carry out services for a port in which they have an interest and that the applicant will avoid all such conflicts of interest.

3.6 Payment and Withholding Tax

Any payment made for Consultancy under this contract will be a matter between the RSO (Ports) and the client, generally the port. All financial transactions must be in accordance with the taxing requirements of the Revenue Commissioners.

3.7 Tax Clearance Certificate

Before authorisation, the successful applicant will be required to promptly produce a valid Tax Clearance Certificate from the Revenue Commissioners. Tenderers resident in Ireland should contact Tax Clearance Section, Collector-General's Division, Revenue Commissioners, Sarsfield House, Limerick, phone +353 1 (0)61 310310. Non-residents should seek a Statement of Suitability from Residence Branch, Revenue Commissioners, Nenagh, Co. Tipperary.

In responding to this document, applicants should state that their tax affairs are in order and that obtaining a Tax Clearance Certificate from the Revenue Commissioners will not pose a problem for them.

3.8 The Department of Transport, Tourism and Sportwill not be liable in respect of any costs incurred by suppliers in the preparation of the application or any associated work effort.

3.9 No work may be subcontracted without the prior agreement of the Marine Survey Office.

3.10 Freedom of Information.

3.10.1 The Department undertakes to use its best endeavours to hold confidential any information provided by applicants subject to the Department's obligations under law, including the Freedom of Information Act, 1997, which came into force on 21st April, 1998.

3.10.2 The Department requires that all information provided pursuant to this Request for application will be treated in strict confidence.

3.10.3 Should you wish that any of the information supplied in this application would not be disclosed; you should identify this sensitive information clearly, and specify the reason for its sensitivity. The Department will consult you about any such sensitive information before making a decision on its disclosure on foot of any relevant Freedom of Information Request, which may be received.

3.11 Conflicts of Interest

Detailed contractual arrangements are not within the scope of this document. However, the following conditions should be noted:

Any conflicts of interest must be fully disclosed to the Department

Any conflicts of interest involving a contractor (or contractors in the event of a group or consortium) must be fully disclosed to the Department of Transport, Tourism and Sport.

Any registerable interest involving the applicant and the Minister of Transport Tourism and Sport, members of the Government, members of the Oireachtas or employees of the Department of Transport, Tourism and Sport or their relatives must be fully disclosed in the response to this Request for Applicants, or should be communicated to the Department of Transport, Tourism and Sport immediately upon this information becoming known to the applicant in the event of this information only coming to their notice after the submission of a bid and prior to being placed on the panel. The terms "registerable" and "relative" shall be interpreted as per section 2 of the Ethics in Public Office Act, 1994.

3.12 Record Keeping

It will be a condition that full records of all RSO (Ports) activities and correspondence relating to this work out are maintained by the candidate. If electronic records are kept then they should be adequately backed-up to ensure security of documentation. Such records are to be maintained for a period of seven years. Failure to comply with this requirement will lead to termination of appointment. Initial snag list, written notes, and final reports are included in the records to be maintained.

3.13 Reference Material

Reference material is to be maintained by the appointed candidates. All such reference material is to be kept up to date. The minimum reference material is to include:

Copies of relevant current EU and Irish Legislation including Statutory Instruments.

Current copy of the SOLAS Convention and the ISPS Code in its up to date form.

Copy of Marine Notices and Marine Security Notices

issued by the Department of Transport, Tourism and Sport.

3.14 Department of Transport, Tourism and Sport / Recognised Security Organisation (Ports) Oversight and Procedures

It will be a condition of appointment that the successful applicant will co-operate with the Department's oversight, auditing and monitoring activities; the scope of which will include:-

Compliance with any restrictions imposed by the Department on the activities that may be carried out by the Recognised Security Organisation (Ports). E.g. Limitation on the number of concurrent port security related activities undertaken by individual applicants.

Audits and operational review by the MSO of the RSO (Ports) activities. Where the MSO is not satisfied with the performance of an RSO (Ports), it may impose restrictions on services to be provided, or suspension, or permanent removal of authorisation.

Rectification procedures necessary before removal of imposed restrictions or suspension.

Attendance at the Committee for the Overview of the Recognised Security Organisations Ports (CORSOP).

Failure to comply with any condition will result in suspension of the authorisation. The Department shall determine the manner in which a RSO (Ports) may be re-instated, if at all. If an RSO (Ports) becomes unavailable to carry out services for any reason they must inform the MSO immediately.

Section 4 Evaluation of Applications and Award Criteria

4.1 General

4.1.1 Responses to this document should be in English.

4.1.2 Applicants to whom any of the circumstances listed in Paragraph 1, items (a) to (g) of Article 29 of Council Directive 92/50/EEC (co-ordinating procedures for the award of public service contracts – see Appendix A) apply will be excluded from authorisation as an RSO (Ports).

Applicants not so excluded will be initially evaluated by reference to the following qualification criteria:

Completeness of the proposal. The proposal should address all of the requirements set out in Section 2 and comply fully with the format for responses set out in Section 5;

Documentation in the form of certificates of competency, degree certificates and other certificates are to be submitted to demonstrate compliance with the requirements. Copies may be sent with the application and the originals will need to be presented prior to being authorised as RSO (Ports)..

The stated ability to fully meet all of the requirements set out in Section 2;

A statement to the effect that the applicant will avoid all conflicts of interest

A statement that the candidate with be bound by the requirements of this document.

4.1.4 Applications that fail to meet these qualifying criteria will be excluded from further consideration.

4.1.5 Should an applicant be authorised as an RSO (Ports) there is no guarantee that their services may be procured.

4.1.6 For the entire duration of their authorisation, applicants are to hold adequate insurance cover for employer's liability, public liability and professional indemnity as appropriate. (This may be obtained after successful authorisation but before port security related functions are carried out). The Department will not be held liable for any claims against applicants and the Department will not indemnify applicants in respect of any claims.

4.1.7 The Department's logo and harp may not be used save with its express permission in writing.

4.1.8 Applicants are not an employee of the Department or MSD and nomination and authorisation as RSO (Ports) is not a contract of employment.

4.1.9 Applicants are established as an independent contractor only and are not a servant, agent or employee of the Department and have no real or ostensible power/authority to bind the Department in any way or make representations on its behalf.

4.1.10 Applicants hereby agree to indemnify the Department in the event of proceedings or claims against it arising out of or in connection with applicant's work associated with the Department.

4.2 Award Criteria

Applicants will be authorised as Recognised Security Organisations (Ports) based on their submission and an interview carried out by the MSO (Marine Survey Office). The following award criteria (in order of priority) will be used:

Demonstrated capability, including qualifications and experience, to effectively carry out security assessments in ports and facilities, produce security plans and provide training and advice to ports in accordance with EU and national legislation.

During the evaluation period clarification may be sought in writing from applicants. Responses to requests for clarification may not materially change any of the elements of the applications submitted. No unsolicited communications from applicants, concerning the selection process will be entertained during the evaluation period.

The Department of Transport, Tourism and Sport may require to interview applicants and key personnel proposed to carry out the work at short notice following the closing date for receipt of applications. Applicants must confirm their agreement to this requirement. Respondents will be required to bear their own costs in relation to any such interviews. The Department of Transport, Tourism and Sport reserves the right to invite some or no applicants to an interview. Short listing for interviews will be carried out on the basis of information contained in the proposals submitted. The Department is under no obligation to appoint any RSOs (Ports).

Section 5 Required Format for Responses to this Document

5.1 Applicants must present their proposals in the format shown in the following section. This is a mandatory requirement. Applications not in this format will not be considered.

5.2 Format

5.2.1 General Information

5.2.2 Name, address, e-mail, telephone and fax number of applicant. Name of person within organisation dealing with the application.

5.2.3 Name, address, email address, telephone and fax number of any third party dealing with the matter.

5.2.4 Confirmation that no third-party will be involved with the work.

5.2.5 Identification of party who will carry overall responsibility for the work.

5.2.6 Confirmation of acceptance by the applicant and any third parties of the conditions of application described in Section 3, including the tax clearance provisions, of the request for applications.

A statement from the applicant that none of the excluding circumstances (a), (b), (c), (d), (e), (f) and (g) listed in Paragraph 1 of Article 29 of EU Council Directive 92/50/EEC (co-ordinating procedures for the award of public service contracts - see Appendix A), applies.

5.2.8 The applicant will be required to document that they hold the required qualifications as set out in this document.

5.2.9 The applicant will be required to document that they hold adequate professional indemnity insurance, public liability insurance and employee liability insurance.

5.3 Requirements

5.3.1 A description of the applicant's understanding of the Department's requirements.

5.3.2 A proposal document which addresses point by point all of the applicable requirements in Section 2.

5.3.3

For individual applicants - A comprehensive C.V. containing specific reference to their relevant expertise and experience in the area of port security. Details of the Quality Management System (and accreditation if applicable) to be established to ensure RSO (Ports) activities are carried out in accordance with requirements

For Companies – Professional profile of the grade of personnel to be assigned the RSO (Ports) work. Relevant details of the Quality Management System to ensure survey activities are carried out in accordance with requirements and details of accreditation of the QMS.

5.3.4 Relevant references for other similar work.

5.4 Costs

Note that all costs will be a matter between the surveyor / company and the client.

5.5 Any Other Information

The applicant should include in this section any other relevant information which they consider appropriate but which is not included elsewhere.

APPENDIX A - ARTICLE 29 OF EC DIRECTIVE 92/50/EEC

Extract from Article 29, Paragraph 1 of EU Council Directive 92/50/EEC of 18th June 1992, co-ordinating procedures for the award of public service contracts.

Any service provider may be excluded from participation in a contract who:

(a) is bankrupt or is being wound up, whose affairs are being administered by the court, who has entered into an arrangement with creditors, who has suspended business activities or who is in any analogous situation arising from a similar procedure under national laws and regulations;

(b) is the subject of proceedings for a declaration of bankruptcy, for an order for compulsory winding up or administration by the court or for an arrangement with creditors or of any other similar proceedings under national laws and regulations;

(c) has been convicted of an offence concerning his professional conduct by a judgement which has the force of res judicata;

(d) has been guilty of grave professional misconduct proven by any means which the contracting authorities can justify;

(e) has not fulfilled obligations relating to the payment of social security contributions in accordance with the legal provisions of the country in which he is established or with those of the country of the contracting authority;

(f) has not fulfilled obligations relating to the payment of taxes in accordance with the legal provisions of the country of the contracting authority;

(g) is guilty of serious misrepresentation in supplying or failing to supply the information that may be required under this Chapter.

Where the contracting authority requires of the service provider proof that none of the cases quotes in (a), (b), (c), (e) or (f) applies to him, it shall accept as sufficient evidence:

- for (a), (b) or (c), the production of an extract from the 'judicial record' or, failing this, of an equivalent document issued by a competent judicial or administrative authority in the country of origin or in the country whence that person comes showing that these requirements have been met,

- for (e) or (f), a certificate issued by the competent authority in the Member State concerned.

Where the country concerned does not issue such documents or certificates, they may be replaced by a declaration on oath made by the person concerned before a judicial or administrative authority, a notary or a competent professional or trade body, in the country of origin or in the country whence that person comes. Member states shall, within the time limit referred to in Article 44, designate the authorities and bodies competent to issue such documents and certificates and shall forthwith inform the other Member States and the Commission thereof.

Further to Marine Notice No 42 of 2011 this Marine Notice provides specific information on the implementation of the 2010 Manila Amendments to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers 1978 , (STCW), as amended, in relation to security training.

The requirements for security training came into force on the 1 st January 2012, and transitional provisions are in place until 1 st January 2014. From 1 st January 2014, all seafarers will require documentary evidence to confirm that they have been trained and certified in security matters in accordance with the new 2010 provisions, which include new anti-piracy elements on board ships to which the ISPS Code applies.

The existing Ship Security Officer (SSO) Regulation VI/5 training remains unchanged.

A. TRAINING REQUIREMENTS

The Manila amendments bring in three new levels of minimum requirements for Security Training under STCW Regulation VI/6 which refers to the requirements of the STCW Code:-

STCW Code Section A-VI/6.
Mandatory minimum requirements for security related training and instruction for all seafarers.

1. Security related familiarisation.

Before being assigned to shipboard duties, all persons employed or engaged on a seagoing
ship which is required to comply with the provisions of the ISPS Code, other than passengers, shall receive approved security-related familiarization training.

The security-related familiarization shall be conducted by the ship security officer or an equally qualified person.

Documentary evidence must be retained by the ship to show that this familiarization has been carried out.

2. Proficiency in security awareness.

Seafarers employed or engaged in any capacity on board a ship which is required to comply with the provisions of the ISPS Code on the business of that ship as part of the ship's complement without security duties shall, before being assigned to any shipboard duties, receive appropriate approved training or instruction in security awareness as set out in table A-VI/6-1.

An STCW Certificate of Proficiency in security awareness must be issued to the seafarer to show that this training has been carried out.
Transitional provisions
Until 1 st January 2014, seafarers who commenced an approved seagoing service prior to the date of entry into force of this section shall be able to establish that they meet the above requirements by previous equivalent training and/or relevant sea service, and can be issued with an STCW Certificate of Proficiency without further training.

3. Proficiency in designated security duties.

Every seafarer who is designated to perform security duties, including anti-piracy and anti-armed-robbery-related activities, shall be required to demonstrate competence to undertake the duties and responsibilities listed in column 1 of Table A-VI-6-2.

An STCW Certificate of Proficiency in designated security duties must be issued to the seafarer to show that this training has been carried out.

Transitional provisions
Until 1 st January 2014, seafarers who commenced an approved seagoing service prior to the date of entry into force of this section shall be able to establish that they meet the above requirements by previous equivalent training and/or relevant sea service, and can be issued with an STCW Certificate of Proficiency without further training.

B. PROVISION OF TRAINING

Approved training providers.

Marine Notice No 33 of 2013 will be updated shortly and will provide details of approved training providers for courses in:

Certificate of Proficiency in Security awareness STCW Regulation VI/6.Section A-VI/6
Certificate of Proficiency in Designated Security Duties STCW Regulation VI/6.Section A-VI/6

In the interim period, candidates for training should contact [email protected] to receive a list of course providers. This training is not subject to revalidation .

C. ISSUE OF STCW CERTIFICATES OF PROFICIENCY

These are issued by the approved training providers or, in the case of the transitional provisions, by the Marine Survey Office, to:

- Holders of Irish Certificates of Competency;
- Holders of Irish Watch Rating Certificates;
- Holders of Irish Discharge Books.

Additionally an ISM operating company may apply to the Marine Survey Office for approval to issue Certificates of Proficiency on its behalf in an approved format to seafarers serving onboard an Irish ship under their management.

Certificates of Proficiency under the transitional provisions will be issued as follows:

Proficiency in Security awareness to seafarers as per Section A-VI/6 part 5.1, who have approved seagoing service as shipboard personnel for a period of at least six months in total during the preceding three years.

Proficiency in Designated Security Duties to seafarers as per Section A-VI/6 part 9.1, who have approved seagoing service as shipboard personnel with designated security duties for a period of at least six months in total during the preceding three years.

Approved sea service is in the period of three years prior to 1 st January 2012.

Evidence of sea service must be submitted in the form of Discharge book, Watchkeeping Certificates or Sea Service Testimonials.

Proof of designated security duties must also be Provided by the Company or Master of a vessel, where applicable.

Seafarers wishing to avail of the transitional provisions through the Marine Survey Office, should submit applications to the STCW Section, Marine Survey Office, Leeson Lane, Dublin 2 as soon as possible.

Approved format of Certificate of proficiency is attached in Annex II.

Annex I contains a diagram showing an outline of the implementation dates of the 2010 Manila Amendments.

#MarineNotice - The Department of Transport, Tourism and Sport (DTTAS) has been advised of non-original GMDSS product batteries being promoted, sold and installed on board SOLAS convention vessels for use in GMDSS equipment required by SOLAS.

In particular, these non-original batteries are being promoted, sold and installed for use in Jotron products type Tron 40S, Tron SART, Tron SART 20 and Tron TR-20 GMDSS.

#MarineNotice - The Department of Transport, Tourism and Sport has been advised that the survey vessel the Normand Subsea (Call Sign: 2CQP8) will commence well works on the Corrib Gas Field, off the coast of Co Mayo, in early October 2013. The works will include replacement of subsea control modules and clamp system replacement.

The vessel, which is expected to be on location for a period of approximately 3 weeks, will be listening on VHF Channel 16 throughout the project. This Marine Notice will be updated if there are any significant changes to either the location or duration of the project.

All Mariners are reminded of the Safety Zone that is in place around the Corrib Gas Field development, referred to in Marine Notice No. 21 of 2006. The co-ordinates of the safety zone are:

The attention of all is drawn to Marine Notice No. 17 of 2007, which gives general advice in relation to the activities of vessels engaged in survey work for hydrographic, seismic, fishing research and underwater operations.

Air Dispersant Training over the Irish Sea

The Department of Transport, Tourism and Sport has been advised that Air Contractors Ireland Ltd. will carry out Aerial Dispersant Training to provide the capability to spray oil dispersant in the event of an oil slick at sea. The training exercise entails spraying of water from a Hercules aircraft flying at 100 ft. above sea level over the Irish Sea. The training exercise will take place approximately 25 miles south-east of Dublin within the boundaries given in the table below.

The training exercise will take place on Sunday 15 th September 2013 between 1600h-1800h (local time) approximately. Timings may be altered due to the participation of the aircraft at the Flightfest Airshow in Dublin.

Vessels in the area are asked to stay clear of the zone outlined in the table above and to be aware that the Hercules Aircraft will fly at a very low altitude of 100ft above sea level.

The Department of Transport, Tourism and Sport has been advised that Rock Placement works will commence along the pipeline/umbilical route from 54°20.34'N, 011°03.51'W to 54°19'54.851"N, 010°00'16.033"W (WGS84). Work will commence in late-September 2013 and is expected to be completed within three weeks

All vessels in the vicinity are requested to keep clear of the works as these works progress along the pipeline route and to comply with requests from support vessel. Furthermore, all vessels are requested to monitor and comply with the Radio Navigational Warnings that will be broadcast for the duration of the works. All vessels involved in the operations will be listening on VHF CH 16 throughout the project .

The survey began yesterday 26 August, and will last around 19 days, weather permitting. The works involve a side-scan sonar, magnetometer, multi-beam echo-sounder bathymetry and sub-bottom profiling throughout the entire survey area.

The vessel MV Chartwell (Call sign MHGV6) is scheduled to carry out the work during 24-hour operations and will display appropriate day shapes and lights during reduced visibility and night operations.

MV Chartwell will be listening on VHF Channel 16 throughout the project and will also be transmitting on AIS.

The work vessel will be towing survey equipment up to 200m and will be restricted in her ability to manoeuvre. All vessels, particularly those engaged in fishing, are requested to give the MV Chartwell and her towed equipment a wide berth and keep a sharp lookout in the relevant areas.
