The Aquaculture Licences Appeals Board (ALAB) has determined that an application for an aquaculture licence for bottom-culture mussel farming at Kinsale Harbour, Co Cork, is deemed withdrawn.
The determination follows appeals against the decision of the Minister for Agriculture, Food and the Marine to grant an aquaculture licence to Woodstown Bay Shellfish Limited for bottom-culture mussel farming on site T05/472A at Kinsale Harbour.
According to ALAB, the Board determined during its consideration of the appeals that further information was required from the applicant under Section 47(1)(a) of the Fisheries (Amendment) Act. The information requested included an Annex 4 Risk Assessment Status Report, a Water Framework Directive Report, a Marine Strategy Framework Directive Report and supporting documentation relating to national planning, biodiversity and climate action frameworks, together with additional information on a range of environmental and operational matters.
The determination states:
"No further information as requested has been received by the Board nor has the Applicant sought any additional period of time within which to furnish the requested information."
The Board also states that it requested a Supporting Information for Screening for Appropriate Assessment Report (SISAAR) and a Natura Impact Statement (NIS) from the applicant.
The determination records:
"No SISAAR and NIS as directed by the AA notice have been received by the Board nor has the Applicant sought any additional period of time within which to furnish the required SISAAR and NIS."
ALAB concluded:
"As a consequence, the Applicant's application for an Aquaculture Licence is deemed to be withdrawn by virtue of the provisions of Regulation 42(4) of the 2011 Regulation and this Appeal is determined accordingly."
In a notification issued to the parties on 25 June, ALAB stated:
"The Applicant failed to furnish a Supporting Information for Screening for Appropriate Assessment Report and a Natura Impact Statement as requested within the specified period. Accordingly, the licence application that is the subject of the appeals is deemed withdrawn in accordance with regulation 42(4) of the European Communities (Birds and Natural Habitats) Regulations 2011 (as amended)."
